The sale shall be for cash and in addition the purchaser shall pay:
Immediately after conclusion of auction the highest bidder shall unless other arrangements are made with the auctioneer, deposit with auctioneer an amount sufficient to cover the auctioneer’s commission and further: (a) Advise the commissioner appointed by Sheriff, attending the sale of the manner in which he intended to make payment of the purchase price and other costs and charges in terms of these conditions to satisfy the commissioner as to his bona fide and ability to meet his obligations. (b) Effect payment to commissioner of the whole purchase price in cash or by cheque or bank draft drawn to the order of sheriff. (c) Bidding cards are available on day of auction on payment $100.00. non refundable
NB: The highest bidder may not withdraw his bid prior to the date of confirmation of the sale or rejection of his offer. If he elects to withdraw, he forfeits his security deposit.
The Sheriff reserves the right to regulate the bidding and refusal of any bid.
CONDITIONS AND REQUIREMENTS FOR ONE TO PARTICIPATE IN THE SALE
a) To participate in the sale of prospective purchasers shall deposit the sum of $10 000-00 with the appointed Auctioneer, Bard Real Estate at least two days before the date of the sale in execution, which amount should reflect before the auction day.
NB: Any deposit paid by a tenderer shall ONLY be refunded in full under the following circumstances:-
i) To all unsuccessful bidders or
Ø However in the event of the highest bidder failing to pay the full purchase price or breaching any conditions of sale well after he/ she has been confirmed purchaser, the deposit paid shall be refunded less the Auctioneer’s commission (including VAT), US$600.00 being security for costs, Sherriff’s cancellation fee it being 10 percentum of the $10 000.00 deposit and any other expenses incurred by the Auctioneer in the process of conducting the sale and its aftermath.
b) In the event of the highest bidder failing to pay the full purchase price, the Sheriff retains the right to proclaim the second highest bidder to be the purchaser provided the price offered is reasonable. c) In addition to the purchase price, the purchaser shall pay:
i) The auctioneer’s commission of 5% of the purchase price plus 15% VAT.
NB: This shall be paid directly to the Auctioneer upon conclusion of the sale unless other arrangements are made with the Auctioneer.
